Jury convicts Troy man of triple manslaughter

A Doniphan County jury found a Troy man guilty Wednesday of involuntary manslaughter in the traffic deaths of three Macon County men on U.S. Highway 36 last August.

Robert D. Cluck, 41, was convicted on the third day of his trial at the Doniphan County Courthouse, according to a District Court spokeswoman. The jury found Mr. Cluck innocent of one count of aggravated battery, driving under the influence, and improper passing, she added.

He was charged in connection with the deaths of Brian Hruska, Joshua A. Berry, and Cody Seward. The men — all in their early 20s and from Macon County, Mo. — were bound for Clay Center, Kan., to work on a fiber optic cable project. A fourth man, Robert Young, drove the Ford pickup the men were traveling in to the job site and suffered a bruised lung in the crash.

The wreck occurred on Highway 36 between Wathena and Troy. Mr. Berry and Mr. Hruska died at the scene, while Mr. Seward died at Heartland Regional Medical Center.

Mr. Cluck was driving a Chevrolet Corvette that was attempting to pass the truck on the highway, when the crash occurred.

Sentencing is set for July 2, the spokeswoman said.
