Two plead not guilty in federal court

KANSAS CITY, Mo. - Two men allegedly connected to a dogfighting ring appeared in federal court in blue jumpsuits and shackles Friday, but left in street clothes.

Rick P. Hihath, 55, St. Joseph, and Cris E. Bottcher, 48, Gilman City, Mo., pleaded not guilty to three felony counts before being released on $10,000 bond.

According to the indictment, the men were part of a group with five others who acquired and bred pit bulls for use in dogfights. Two such fights allegedly occurred on Mr. Bottcher's property at 33335 E. State Highway CC in Harrison County near Gilman City on Feb. 28 this year. Mr. Hihath fought a dog named "Black Sheep" and Mr. Bottcher handled a dog named "Pope Joe," officials said.

Both men are alleged to have constructed the fighting pit, and one refereed while the other handled a dog. Both men are alleged to have placed bets on the fight.

The men spoke in hushed tones to their lawyers Friday, but neither addressed the court.

Jan Brown, a prosecutor representing the government, argued for their detainment, as both men have prior records and a history of marijuana use. She said Mr. Hihath, a school teacher at the Helen Davis State School, was convicted of "terroristic threats" in 1997 and served six days in jail. She said he also violated a protection order in 2004 and that he "does not have respect for court orders."

Ms. Brown said Mr. Bottcher has a marijuana offense dating back to 1980 and that he used again as recently as a week ago.

Defense attorneys argued that the accused have long employment histories and supportive families who were in the courtroom Friday. If released on bond, the attorneys argued that their clients would be compliant to conditions of release, which include no contact with dogs. The judge, Sarah Hays, denied the prosecution's motion for detainment and set bond at $10,000.

Ms. Brown said Friday that undercover agents from the Missouri State Highway Patrol infiltrated the dogfighting ring and videotaped three fights in which both men were active participants. She described it as a "heinous crime" and that the defendants inflicted harm "beyond words."

A dogfight occurred at the property in April involving several others from Iowa and Nebraska, according to the indictment, which claims that Mr. Bottcher killed two dogs with a .22 caliber rifle at the end of the fight. A third fight allegedly occurred in May at Mr. Bottcher's residence, where approximately $5,100 was wagered.

The trial date is set for Aug. 24. If convicted, the men face a maximum of five years in prison, a $250,000 fine and three years supervised probation on each of the three counts.

I PERSONALLY FEEL THESE GUYS SHOULD BE KEPT IN PRISON FOR THE REST OF THEIR LIFE IF FOUND GUILTY!! AND ABSOLUTELY NO BAIL. THIS KIND OF BEHAVIOR IS TOTALLY OUTRAGOUS AND NEEDS TO BE FOLLOWED UP ON, TO CATCH THE OTHERS INVOLVED!! GO GET THEM GUYS, AND GOOD JOB SO FAR!!!

Why in the world would a school, especially one for special needs, hire anyone with that type of background history? Just because someone has an irrelevant diploma should not qualify a person for a job, especially with children and adults? I don't have that type of record and wouldn't even dream of those things, and need a job! The parents should stand up and demand an immediate dismissal, starting with the past record(s)!
$10,000 bond! Get real! That's $1,000 to bail out. That's betting money/earnings!
I believe that judges/attorney's have had some sort of psych course in their past. They need to reread the chapter concerning what personalty a child/person has that can abuse an animal.
They limit this to "no dog contact"? That should be "NO ANIMAL CONTACT".

I am wondering why Mr. Hihath is still employed by the Helen Davis School. Do they not have any guidelines when a teacher is arrested for something so heinous as dog fighting? Rather he is found guilty or innocent, teachers are leaders and are thus held to a higher moral level by society. What a slap in the face to moral teachers all across Missouri with this outrageous action by this teacher. How did he pass his background check if he was arrested for "terroristic threats" in 1997??? Do these dog fighting idiots need the money so badly that they have to break the law, and sneak around to earn money gambling on this blood sport all the while torturing and killing the dogs that cannot fight well? Could they not take a second job or cut back on their budget instead of partaking in something less vicious and perhaps not illegal? Could Mr Hihath, be thinking he is above the law, since he apparently got a slap on the wrist with his terrist threats of 1997? I am disgusted with people who can hurt an animal and then sleep at night. If he is convicted, he should be fired without pension for violating the morality code, if they have one in their contract. I could lose my license for such a thing in my field. I wonder did he lie on his application for employment at Helen Davis? If so, fired without warning or compensation is what he would get were I in charge.

Why would "any" school hire this low-life knowing he has a criminal background? And absolutely no way would our family be "supportive" of a relative committing such heinous acts! Congratulations to the under-cover agents who caught them. A shame the judge released them on bond, they belong in cages.

I personally know some of the staff who work at Helen Davis School and can guarantee that this scandal is going to continue to wreak havoc for a very long time. I have recently talked to some of the staff about this situation and they are all very upset and concerned. This has already started a division among the staff, which is quite sad-most are extremely dedicated to their profession and strive to maintain positive action and interaction with the public. My biggest concern right now is that the "innocent until proven guilty" motto is going to be applied here--that man is actually planning on going back to the school until his trial date--I wouldn't want any child of mine, let alone a special needs child, anywhere close to this person. The children cannot, for the most part, communicate that any misdeed has been done-and, in my opinion, if a person maims and kills dogs, it is not a big leap to harm a child.
