One of the alleged leaders of a burglary ring that targeted St. Joseph homes, businesses, schools and churches received a 15-year sentence in Buchanan County Circuit Court on Friday.
Judge Dan Kellogg sentenced Timothy Scott McCoy, 19, to five years for each of the three counts of second-degree burglary he faced, to be served consecutively.
Ron Holliday, the first assistant to the prosecutor, called on St. Joseph detective Scott Coates to testify during the hearing. Mr. Coates served as the lead investigator on the case, and his testimony brought various aspects of the 10-man burglary ring into clearer focus.
Mr. Coates said the defendant and his brother, Robert J. Manassero, 23, lived in a house on Monterey Street, which served as home base for the operation. After the estimated 20 to 25 burglaries the group performed, they brought the stolen merchandise (mostly high-end electronics such as laptops and flat-screen TVs) back to the house. They then sold the goods to friends or on the Web site Craigslist, according to the detective.
In Mr. McCoy’s statement to detectives, the St. Joseph man admitted taking part in six of the burglaries. Prosecutors just charged him with breaking into Central High School, a residence on Prospect Avenue and St. Francis School.
According to Mr. Coates, police received their first tips from Mr. McCoy and Mr. Manassero’s girlfriends, who also lived in the house on Monterey Street. Courtney Kline, the third of the alleged ringleaders, was the first of the group to cooperate with police and issue a statement. Mr. Coates said that when Mr. McCoy and Mr. Manassero found out they were the subjects of an investigation, the brothers fled to California.
When they returned, police arrested the duo at the Motel 6 on Frederick Boulevard.
Dawn Williams, Mr. McCoy’s private defense attorney, said her client intended to turn himself in both before and after the California trip. Mr. Coates countered that police received three separate promises that the brothers would surrender to police, none of which the suspects kept.
Mr. Holliday asked for the maximum sentence on each of the three counts — seven years — to be served consecutively. The assistant prosecutor asked the judge not to consider the defendant’s plight, but that of the community. He requested the court send a message to other potential burglars out there that taking the easy route to make money would not be tolerated in Buchanan County.
“At some point during the commission of a criminal enterprise, we have to stop thinking about Mr. McCoy, his girlfriend and his mother,” Mr. Holliday said. “He committed numerous crimes that had a devastating effect. He invaded the most sacred part of everyone’s life. That is their home.”
Ms. Williams argued that her client declined to post bond the past five months so he could sit in jail and reflect on his actions. She added that the defendant had a drug problem and needed treatment, not a sentence that could prevent him from turning around his young adult life.
“He has shown severe remorse,” she said. “He knows how it has affected (the victims).”
In handing down his decision, Judge Kellogg noted this was a series of crimes that spanned at least three months, not a one-time thing.
“You’re just running the gamut, and it’s all because you went the easy way,” Mr. Kellogg said.
The judge added that by shirking a high school education and turning to crime, the defendant actually hurt others’ education and future prospects by stealing equipment that contained Central students’ portfolios.
Mr. Manassero’s sentencing is scheduled for Dec. 10 in front of Mr. Kellogg. Eight of the 10 charged in the ring pleaded guilty already, with cases still pending against Jeremy W. Hayden, 20, and Justin M. Hughes, 19. Tyler J. Stout received 10 years, Donald M. Lehman five years and Bryson D. Pankau, 18, three years for their involvement.
Mr. Kline received a five-year sentence on just one charge because of his initial cooperation with police, despite being one of the alleged ringleaders.

Maybe if YOU had to pay that $500 deductible required to fix the broken windows and damaged door. Maybe if YOU had the things you've worked so hard to buy taken from you in seconds...
I was raised that everyone makes choices in life. Sometimes, those choices are bad ones, and will result in penalties. When I was a child, I paid penalties for disobeying my parents, for breaking the rules in our home, or for other things. The penalties ranged from a spanking down to grounding or sitting in the corner. I discovered, very early, that penalties typically fit the crime, and became more severe with repeated bad behavior. I also found out that penalties were what modified my bad behavior, and made me make better choices in the future. Punishment is a part of breaking the rules. As you said before....only time will tell if that punishment will be enough to modify the behavior of these guys. If it does, WONDERFUL! However, I have a feeling that had they not been caught, their bad behavior would have continued. I hope, for your sake, this is the end of it.
I'm glad these scum-bag losers got what they deserved! Things could have turned out a lot worse for them! You break into the wrong(or I should say right) house in town(aka mine), and you WILL be leaving in a bag! I'm glad to see that justice was served for once. Yeah I do believe they would have turned and ran.. none of them carried weapons on them actually. I cant speak for all the boys but I can speak for some.. They were not violent people and they would never do anything to physically hurt anyone... Sorry but in any of these stories does it say they carried a weapon on them?? NOOO. A couple of these boys I know for sure know what they did wrong and would not do it again...Do they really deserve prison time for this crime...Hell NOOO! Maybe if the punishments for those who are convicted of a crime in this country were more harsh them maybe there would be less repeat crimes. I may not of been there with the boys when they burglarized Central (that is the only one my son was charged with), but i do know that these boys are not violent! I really hope for all their sake that once their time is served that EVERYONE of them are able to come home and have their families support them and try to make a mends with what they have done!

i was one of them who broke into a house and i can say for a fact that we never carried weapons or thought about that never even thought about physicaly harming anyone but i guess all of you are mind readers and know everything. im sorry for what i did and i can say the same for most of the boys involved we will do are time and get on with are lives
This just in: People don't like the idea of other people breaking into their homes and taking things that they WORKED hard for. Weapons or not if they are unlucky enough to get into a house that has an armed resident they could be shot and the home owner would be well within their rights to do so.How is someone to know if the person breaking in is looking for a stereo or tv or are they a rapist, kidnapper, or murderer? At my house I will do what is necessary to protect my family.

And for the record, I have had no run ins with the law besides speeding tickets. Know why? Because I work for a living and don't feel the need to steal other people's hard earned belongings. And as far as a gun owner making a bad decision by shooting someone in the home, how is that a bad decision? Am I supposed to welcome them in? Maybe make them some breakfast? Or ask them politely to please leave so as not to offend them?

He didn't get shot in the commission of his crime, or severely beaten. That's VERY EASILY what could happen in the future. its not as easy as some folks think to take another life. i came from a god fearing family and the first time i had to use my weapon in nam made me sick because of my up bringing. i don't regret it,just makes you wonder about the other guy. we all have mothers. he was just kid like me 18 and probably just as scared sh--less as me. so don't take life lightly. when you shoot someone theres always two victims,but on the other side if you threaten my family i would have no qualms to do what i takes to protect them.
The bottem line on these Burlaries and home invasions is the fact that; even though nobody on both sides of the crimes were injured or killed it can and does happen! you cant tell me that when a owner of a residence accidentilly walks in on the crime while it is taking place isnt in danger,,as most of these criminals will do almost anything not to get caught when facing long prison terms they may not actually want to kill someone , but just shoving somebody off their feet can cause a fatality if the circumstances are right.... hitting their head,heart attacks and so forth, espcially when the perpetraitors possibaly already have a criminal record.... but on the other hand the property owner cant use deadly force either unless his life or familys life is in imminent danger....if the criminal is attempting to flee and you shoot him that is against the law, if you turn loose a pack of mean dogs on a thief ,that is against the law ,,booby trapping your home to prevent future intrusions is also against the law..... basically what im trying to say ,is that criminals have rights too , weather people want to believe they should or not... its a double edged sword so be carefull before you act!!!!

You should read up on the Missouri Castle Doctrine and you'll find out that you are incorrect.I have copied the site below for you. Even if someone is trying to escape the commission of the crime, if they are on your property, you are still within your rights to shoot them. There was a case in Texas about this not too long ago where a man killed two men breaking into his neighbor's house by shooting them in the back while they were fleeing. The neighbor entrusted his home to his neighbor, and therefore the property was technically his to defend. This IS the same case in Missouri. And you state that "the property owner can't use deadly force unless his life or family's life is in imminent danger". Well if someone is entering my home, I'm not asking why, so I will assume that I am in imminent danger since I will not stick around to see the burglar's/murderer's intentions.

Nobody is WANTING for your son to fail. Nobody MADE him do what he did. You're not "proving everyone wrong", since "everyone" doesn't want your son to "fail". And I think most people on here would sincerely tell you that they do hope that he comes back reformed, so I think you should stop with the whole "us vs. them" mentality. You need to realize the world isn't out to get you or your son, but rather your son was punished for a CRIME that HE committed. Nobody made him do it, so the "us vs. them" doesn't fly here.
bryan 3506 after reading the M.c.d I do agree with you about how it reads concerning entering a dwelling and imminent danger ...but there also appears to be a fine line drawn between the use of force when the felons are detained by the owner of the dwelling during the crime,, which i assume would most likely be brought to a conclusion by a jury or judge if the doctrine was to ever come into play !!

Funny, SMOKEY2, how you just can't see that your son is paying a penalty for what HE committed. None of us forced him to commit the crime. He made that choice himself, and he has to live with the penalties that result from his actions. I just don't understand where your anger toward me comes from. ole pops, Reading all these comments has made me realize how wonderful our world really is . We the people do not believe in second chances ,we should judge people for all the bad they do , not the good they have done . I now know how to defend myself incase I am ever involved in a home invasion thanks to all the great people that made these great comments . First of all , I'll hit them with a 2x4, shoot them between the eyes, and take them out to the timber ,tie them to a tree and let all the little critters dispose of the remains , even though this person had never been in trouble before , it just makes common sense , doesn't it ? I personally have different thoughts about how I would handle the situation .If I could handle it without anybody losing their life ,that's how I would handle it , if not then I'll deal with it if it ever happens . Just a though If these boys were caught and were sentenced then they must do their time.After they do their time they will be back in the community at which time they must follow the laws like everybody else does.I know if I was asleep in my home and was awaken by someone in my home that did not belong they probably would not make it out.This is called me being a father and a husband and making sure my family is not in harms way and protected.I would rather someone ask me for something then steal from me.I have no idea what these boys were thinking but they will have to serve their time for their crimes and one could only hope they have learned their lesson.They will have a second chance and I truely do hope they take advantage of it.But the name calling is doing nobody including your children that are serving thier time any good.

Oh, p.s...as far as commenting on the actual story, in my opinion, judgement belongs to the Lord. I do not disagree that people have to abide by laws and serve their punishment. However, I am not a judge, jury or lawmaker so I can only hope justice was carried out by those who are in that position. It seems the accused got a fair sentence for the crime.
