GALLATIN, Mo. — A paperwork mistake led to the dismissal of a felony bad check case against Daniel Froman, the former owner of the Gallatin Grain Co.

“The mistake was mine but it will be re-filed with the correct information,” said Keith Sutton, a Jamesport, Mo., farmer.

The state filed a felony bad check case in June alleging that Mr. Froman, 64, wrote a check for $10,000 to Mr. Sutton without sufficient funds.

“The date the check was written in February was off by one day because I remembered the wrong time,” Mr. Sutton said.

Mr. Froman has other criminal cases to worry about. A Circuit Court hearing on 25 felony charges alleging grain stealing and false financial statements scheduled for Thursday has been postponed because of the appointment of a new judge. Monday, the Daviess County Circuit Clerk’s office received a written notice from the Missouri Supreme Court appointing 4th Circuit Judge Roger Prokes to hear the case.

Court records also provided more information about the newest felony criminal case against Mr. Froman. Those involve two charges of tampering with a witness and sexual assault.

A probable cause statement filed with the court by Sgt. David Merrill, an investigator with the Missouri State Highway Patrol, reveals a few details about three new felony charges filed Aug. 22.

According to the court document, the alleged sexual assault occurred on a Saturday in January and Mr. Froman allegedly came to the woman’s house the following day and paid her $1,000 to keep quiet, the sergeant said. The third incident occurred Aug. 20 when Mr. Froman allegedly told the woman not to talk to an investigator.

Mr. Froman remains free on a $35,000 bond in connection with these charges.
